Requirements for video surveillance:
The use of video systems to monitor public areas or business premises is not permitted without restriction.
The applicable legal framework is based on the EU General Data Protection Regulation (GDPR).
Although the GDPR does not contain specific paragraphs dedicated exclusively to video surveillance, such activities must be assessed under the general clause of Article 6 (1) sentence 1 lit. f GDPR.
Accordingly, the collection, processing or storage of personal data is only permissible if it is necessary to protect the legitimate interests of the controller or a third party, and if these interests are not outweighed by the rights and freedoms of the individuals concerned.
This means the interests of the organization must be carefully weighed against the rights and freedoms of affected persons (e.g., customers or employees).
A legitimate interest may be assumed, for example, in the presence of a demonstrable risk or threat, which is often influenced by the industry or business environment – such as the surveillance of retail spaces where valuables are sold.
Similarly, evidence preservation can also constitute a legitimate interest.
The video surveillance process must be recorded in the record of processing activities as stipulated in Article 30 GDPR.
Additionally, it is essential to ensure that appropriate informational and warning signage is clearly visible in all monitored areas.
